The 3-Day Notice to Perform Covenant or Quit is appropriate where the tenant fails to perform a contractual obligation other than paying rent. The tenant then has three days to perform their obligations or move out. For example, say the lease prohibits the tenant from owning a pet, but it turns out the tenant owns a pet. The landlord can issue this notice and give the tenant three days to either get rid of the pet or vacate the unit.
The 3 Day Notice To Perform Covenant Or Quit should include the following topics:
1. Conspicuously type “THREE-DAY NOTICE TO PERFORM COVENANT OR QUIT” at the very top of the page to avoid ambiguity.
2. Address the notice to each tenant whose name appears on the lease agreement, along with other known adult occupants.
3. List the unit’s full address.
4. Specifically state how the tenant violated the terms of the agreement.
5. Clearly state that the tenant must either fix the problem listed above within three days, or surrender possession of the unit. Make it clear that you will otherwise commence a legal proceeding against them where you will seek possession of the unit, along with any unpaid rent, other damages, court costs, and attorney fees.
6. Instruct the tenant of what actions he must take to comply with the agreement, and require the tenant to provide you or agent with access to view the unit by the end of the third day to verify compliance.
7. Sign and date the notice.
